U.S. District Judge Christopher C. Conner in Harrisburg today said Congress exceeded its powers under the federal constitution when it included in the act Obama signed into law last year a provision requiring almost all Americans to have medical insurance starting in 2014.

The federal government is one of limited enumerated powers, and Congress’s efforts to remedy the ailing health care and health insurance markets must fit squarely within the boundaries of those powers.

Three federal appeals courts have weighed in on the issue since June 29. A Cincinnati panel backed the provision, 2-1, while one in Atlanta voted it down by the same margin. The U.S. appeals court in Richmond on Sept. 8 rejected two separate challenges on jurisdictional grounds.
The Harrisburg ruling, if appealed, would be heard by the U.S. Court of Appeals in Philadelphia, which hasn’t yet ruled on the merits of the Patient Protection and Affordable Care Act.

The president’s health care overhaul includes a 2.3 percent excise tax on medical devices that will send the durable medical equipment industry into intensive care, eliminate 43,000 jobs, and whack $3.5 billion from local shops and communities, according to a new study by two free market economists.

President Barack Obama on Monday proposed paying for his jobs plan by eliminating $467 billion in tax breaks for wealthier Americans and corporations, triggering a new battle with Republicans in Congress. The White House objective is to put lawmakers in a difficult spot: Back Obama's jobs package or risk being portrayed as doing nothing to improve the U.S. unemployment crisis heading into the November 2012 elections.  His plan will do nothing but "KILL" the middle class.  We are already on the edge of collapse and now President  Obama wants to hit us again with higher TAXES.   BAD IDEA!!  NO NO NO you got to GO.

The president, who pushed through an $800 billion economic stimulus package in 2009, will see his re-election chances hinging heavily on his ability to reduce stubbornly high unemployment above 9 percent.
The bottom line for Republicans was that Obama is now trying to pay for his jobs plan entirely with tax increases.   STOP STOP STOP STOP!  NO MORE stimulus we are starving and homeless!

Hell Mr President just do not do anything we do not want or need your help it costs to much!
But the Democratic president's proposals to pay for his $447 billion jobs plan will be hard for Republicans to swallow. They said the idea of taxing the wealthy and corporations was not in keeping with a bipartisan path he was seeking.  We need real jobs not UNION JOBS.
